General Terms and Conditions (GTC) of Allgäu Camping Brunnen GmbH & Co KG

1. Scope of Application

1.1. These General Terms and Conditions ("GTC") apply to all contracts concluded between Allgäu Camping Brunnen GmbH & Co KG, Seestraße 81, 87645 Schwangau ("Campsite" or "We") and its customers ("Customer" or "Guest") concerning the use of the campsite and/or the restaurant and minimarket.

1.2. Deviating, conflicting or supplementary terms and conditions of the customer shall not become part of the contract, even if known, unless their validity is expressly agreed in writing.

2. Booking and Conclusion of Contract

2.1. Bookings for pitches or tables in the restaurant can be made by the customer in person, by telephone, in writing, or via the campsite’s online booking system.

2.2. By making a booking, the customer submits a binding offer to conclude a contract. The contract is only concluded upon written confirmation of the booking by the campsite and receipt of the required deposit—whether by email, letter, or other written means.

2.3. Special conditions apply to group bookings and special events; these must be agreed separately.

3. Payment Terms

3.1. Prices for pitches and meals are based on the current price lists of the campsite and restaurant, including VAT.

3.2. Payment is due upon arrival or immediately after invoicing unless otherwise agreed. For online or telephone bookings, a deposit is required. The deposit is at least 50% of the total price but not more than €350.00. (As of: 24.06.2024)

3.3. Payment can be made in cash or via standard payment methods (e.g. cash, EC card, credit card, or bank transfer).

3.4. In case of late payment, we reserve the right to charge interest on arrears of 5 percentage points above the base interest rate.

4. Cancellation and Withdrawal

4.1. Cancellations must be made in writing. The following cancellation conditions apply:

- For cancellations up to 14 days before the planned arrival date, only a processing fee of €15.00 will be charged.
- For cancellations from the 14th day before the planned arrival date or in case of no-show, the deposit (50% of the total booking price, max. €350) will be retained.
- In case of shortened stays, the deposit is also retained.
- For stays shortened by two to four nights, a shortening fee of €20.00 will be charged; from five nights, the fee increases to €50.00.

4.2. The campsite reserves the right to cancel bookings or terminate the contract in the event of force majeure or unforeseeable events. In such cases, the amount paid will be refunded, but no compensation or damages will be owed.

5. Use of the Campsite and Restaurant

5.1. The customer agrees to treat all facilities of the campsite and restaurant with care and to use them according to the rules.

5.2. Quiet hours must be observed. Night rest is from 10:00 p.m. to 7:00 a.m. During midday rest (12:00 – 2:00 p.m.), only essential vehicle movement is allowed; loud noises are to be avoided.

5.3. Pets – especially dogs – are only allowed after prior arrangement and for a fee. A maximum of two dogs per pitch is permitted. Dog enclosures are not allowed.

5.4. Open fires are prohibited. Grills using charcoal or gas are allowed. Excessive smoke must be avoided. Open fires are only permitted at designated fire pits and with staff permission.

5.5. Vehicles must be parked on the booked pitch. Parking elsewhere is only allowed after consultation and for a fee.

5.6. The use of drones over the campsite is strictly prohibited.

6. Liability

6.1. The campsite is liable for damages caused intentionally or by gross negligence by its staff.

6.2. Liability for slight negligence is excluded unless essential contractual obligations are breached.

6.3. Liability for injury to life, body, or health remains unaffected.

7. Final Provisions

7.1. German law applies.

7.2. If individual clauses are or become invalid, the validity of the remaining provisions shall remain unaffected. The campsite rules must also be observed.

7.3. Place of jurisdiction for all disputes arising from or in connection with this contract is Füssen, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
